(KON) – Araya Air Pane and the lawyer of the Alamida County Ursula Jones Dixon filed a joint civil lawsuit against a recycling of a radius due to air quality violations related to the pseudonym that was burned at the Metal Company in West Oakland in August 2023.
“The Radius recycling actions were at risk of the health and well -being of the West Oakland community, a region that is already burdened with decades of air pollution,” said Dr. Philip Fine, CEO of the Air District.
The large fire of aluminum, tin, steel and iron was sent in the air. The particles were moved in the far south like Milpitas and north like Martinez.
Fine said: “This lawsuit and procedures reflect the permits of the fixed air area to protect societies, accountable for pollutants and ensure that facilities such as a radius circle work in full compliance with air quality regulations and their requirements.”
The lawsuit seeks to feed with penalties against recycling a radius from the alleged negligence related to August 9, 2023.
Radius Recycling decreased at the time, but the company continued to accept more scrap to run out of space to store it, the lawsuit said. After running out of space, workers put scrap materials in an area that is not equipped with water cannons, to keep the wet material and heat detection cameras, to discover the increase in the dangerous temperature. These decisive measures for hacking from fires are required under the air permit for the facility, according to the case.
According to the lawsuit, Radius Recycling’s failure to monitor the temperature of the high materials was a great factor in creating the conditions that caused the fire.
The company’s managers were criminally charged last year. Radius was previously known as Schnitzer Steel Industries, and the Metal Company has a history of environmental violations. In 2021, the investigation of environmental law violations led to a $ 4.1 million settlement between Schnitzer Steel and the state.
Da Jones Dixon said: “My office is committed to enforcing environmental laws that protect our society from air pollution and accountable companies from their toxic emissions,” said Da Jones Dixon. “This joint civil lawsuit seeks to make Radius to comply with the current law and regulations and requires more protection to prevent future toxic air pollutants from affecting West Auckland.”
