Medical exceptions for abortion addressed in Texas House Committee

ASAN (KXAN) – The Texas Public Health Committee in the House of Representatives has witnessed a public certificate on a draft law to clarify medical exceptions for abortion in Texas.

The life of the mother, or HB 44, shows some language in the current draft law that brings doctors to perform life -saving care for women because she will require abortion. By doing this, it is hoped that doctors feel more confident in disposing of their reasonable medical judgment to provide this care.

“The life of the mother law has gathered all the main supportive groups: doctors, hospitals, Republicans, democrats and people on both sides of the abortion issue,” said Bill, MP Charlie Jereen, R-Fort Worth. “It is simple, we do not want women to die from medical emergencies during pregnancy.”

after The US Supreme Court Resolution is to cancel Roe V. WadeTexas has taken steps to prohibit abortions throughout the state with a few exceptions. In light of the medical conditions that created uncertainty about when it is appropriate to intervene to save the life of the mother or the fetus, supporters from both sides argue that the exceptions of the draft law remain very restricted.

Possible consequences are high. Doctors face imprisonment for up to 99 years, a fine of at least $ 100,000 and the loss of their medical license if convicted of illegal abortion. In addition, they may face expensive civilian claims under the Texas Pulsation Law, also known as the Senate Bill 8, which allows any citizen to prosecute anyone who believes that he is performing or helped facilitate abortion for at least $ 10,000.

“HB 44 does not change the state’s position on optional abortion, it simply clarifies the law and provides additional protection when doctors exercise a reasonable medical judgment to protect a pregnant patient life or health.”.

One of the ways the draft law is to remove the phrase “life -threatening”, explaining that the exception to the prohibition of abortion in the state is when there is a threat to the life of the mother or the danger of great weakness of a great physical function. The phrase “life threatens” was a point of confusion for doctors who were not clear whether “life threatening” indicates the direct condition of the patient or their condition at some point in the future. Removing this language would reduce hesitation in these scenarios.

Brock Knodson will see her experience with the consequences of this hesitation. Knudtson Strange lost her pregnancy in 2023 after finding a near rupture in her Fallopian tube. Although the signs of warning and reporting it were shown to her doctors, her symptoms were said to be normal until it is too late.

“There is something that I learned through all of which is that I am defending my only and for this reason I am here to support HB 44. Because this is not related to politics, it is a matter of proper nature, and to ensure that women are like me – misfortunes, wives, and ambitious mothers – in obtaining the care we need.”

In addition, the draft law shows that doctors who practice a reasonable medical judgment when determining the course of work in these cases will not undergo disciplinary measures.
