Davenport, Florida (WFLA) – A McDonald’s customer in Florida was shot by a restaurant employee during a dispute over being denied service late at night.
At about 3 a.m. on Oct. 12, Peter Story, 19, and Nicholas Jones, 18, were denied service at a McDonald’s restaurant in Davenport, located about 35 miles southwest of Orlando, because the restaurant was too crowded, according to arrest reports from the Polk County Sheriff’s Office.
The couple argued with the delivery employee, identified as Yuan Soto, 21, and told him they were “going to hit him with a f—” and wait for him in the parking lot. They entered the restaurant lobby and continued to argue.
The store manager tried to calm the situation and asked Storey and Jones to leave the store, but the arrest report said they refused. She told deputies she heard the men point to firearms and mentioned “30 clips” and “wrenches.”
Soto went into the break room and pulled a gun out of a backpack, the arrest report said. He left the restaurant through the back door, returned to the lobby, and approached the two men from behind.
A struggle ensued and the gun fired, hitting Storey in the neck. His injury was considered non-life threatening. The men then left the restaurant.
PCSO said Soto put the gun in his waistband, grabbed his backpack and picked up the spent shell casing “telling the employee it was his” before leaving the restaurant.
Deputies found the jacket and clothing Soto was wearing at the time of the incident during a search of his home, according to the arrest report. PCSO said he admitted to removing this evidence from the shooting site.
Soto was charged with tampering with physical evidence. Storey and Jones were charged with disorderly conduct and trespassing.
