(KRON) – A San Mateo driver who struck another driver’s car multiple times because the victim was running his high beams was sentenced Tuesday for assault with a deadly weapon.
Frank Falcone, 62, of Bowling Green, Kentucky, was sentenced to 90 days in jail, 32 hours of anger management and two years of supervised probation for the Jan. 12 incident, according to the San Mateo County District Attorney’s Office.
The San Mateo Police Department said Falcone was driving on Pacific Boulevard at 3:49 a.m. when he approached another driver in the opposite lane who had his high beams on. Authorities said this disturbed the Falcon due to the extreme brightness and “potential radiation.”
Falcon traveled at 15 mph and struck the victim’s car, according to prosecutors. He then struck her two more times while the victim’s car was idle and the airbags deployed. The victim feared for his safety and called 911 as Falcon fled the scene, the prosecutor’s office said.
The Belmont Police Department engaged in a short pursuit with Falcone until it ended on 43rd Avenue. The San Mateo Police Department said Falcone fled from pursuing Belmont police officers “based on the fact that people were posing as police officers.”
Falcone will be required to surrender to prison on January 10, 2026 to begin his sentence.
