The lawsuit in Arkansas was based on a claim that legislation violated federal law, specifically the Farm Bill 2018, which allows hemp products that contain less than 0.03 % of THC.
However, in the decision of this week, the Federal Appeals Committee said that the Arkansas Bill does not interfere with federal law. The committee ruled that, according to the farm bill, individual states can regulate THC products and even prohibit them as long as the states do not interfere with the trade of products between the states permitted under federal law.
We will watch to see how this ruling is escalating while legislators in Texas are restored in a special session on July 21.
