NEXSTAR-Texas members of Texas issued legislation to allow judicial cases against anyone who participates in making or providing drugs that stimulate abortion in the state. Home Law Bill 7 It would allow ordinary citizens to prosecute abortion drug providers if their delivery is used to Texas successfully to urge abortion.
The legislation was issued on Wednesday evening with a vote 17-8 in the Senate. Members of the House of Representatives approved legislation in late August. Legislation is now heading to the governor of the state, Greg Abbott, who is expected to sign him on the law.
“You are making and charging illegal drugs in Texas, and it will be responsible,” said Senator Brian Hughes, pastor of Bill Brian Hughes, pastor of Bill Brian Hughes.
“Texas must defend its citizens, and this is what this law is about,” Hughes added.
The draft law is likely to face legal challenges. Senator Nathan Johnson, Dallas, said he believed that HB 7 violates the constitution by delegating the state to enforce the state illegally to an individual.
“Secondly, by giving a special right to the lawsuit to anyone, he violates the position of the Texas constitution to prosecute the ruling. Third, it violates the legal item due to the constitution of the United States, and the fourteenth amendment, by granting damage to the non -defendant from one of the defendants who did not cause the person’s harm,” Johnson said before the vote.
The law includes several exceptions for those who can prosecute on behalf of the dining fetus, and not to allow those who:
- Drink women through sexual assault
- He committed the crime of family violence
- She came to the property that stimulates miscarriage for a woman without her approval or knowledge
- Be condemned
- Acts in coordination with a person committing crimes above
The draft law will give at least $ 100,000 to a successful prosecutor, but the amount that the plaintiff can recover depends on who they are. If the woman on which the medicine was used – or the father, brother or ancestors from the abnormal fetus – will get a case according to HB 7, they will have the right to obtain the entire amount. No one else has the right to file a lawsuit under this procedure to obtain a maximum of $ 10,000, with the rest to a charity to choose the plaintiff. The Charitable Society cannot benefit the plaintiff or its family, and the court cannot grant law fees in their decision.
Hughes said the capabilities of financial sanctions will help protect what has not yet been born.
