San Jose, California (Crohn) – A mother in San Jose appeared in front of the court on Monday to confront the murder after a overdose of her child on fentanel at home.
Winter was 19 months when she died on August 12, 2023 in the Huddersfield Court of 1550. She accused her mother, Kelly Richardson, her father, Derek Rayo, and the father’s father, Philip Michael Ortega, of killing on charges of filtanil in winter.
They admitted that they are not guilty, and the trio is held in prison without sponsorship.
Before Richardson was tried for murder, another trial will be held to determine her mental efficiency. On Monday, Judge Kelly Paul granted a request made by public prosecutors looking for mental health records in Richardson, who is documented at the time in prison between January and the end of July. The records include reports of psychiatry technician, psychological assessments, progress in psychology and written examinations.
Prosecutors said that parents and drug dealers are linked “together in an incomparable way in the murder.” Prosecutors in the court documents wrote that Richardson, Rayo and Ortega “lived together in the five months leading to the death of the Ministry of Winter, and each of them took the duty to take care of the Ministry of Winter in some capabilities.”
While Rayo was a father at home and Ortega periodically occupied as a cavalry, Winter’s mother had a job asking her to work on evenings, according to court records. Investigators said that drug use inside the house was prevalent.
The prosecutors in the court documents wrote, “Richardson’s phone has pictures … from the defendant Rayo” nodd “due to drug use on the bed close to the winter.
In addition to the seizure of photographic evidence, investigators found text messages and social media that document triple contacts. In Richardson’s messages, she expressed concern about the well -being of her child and a possible drug exposure during winter care by Rayo or Orga.
The court’s documents states that “Richardson faced the defendant Rayo in text messages and social media, for example,” it has passed during the view of (winter) is it not. “Evidence indicates that, in addition to using the drugs herself, the defendant Richardson regularly left (winter) to take care of the defendant even though knowledge of the danger that threatens his life that the defendant has put in their daughter.
Investigators found another text message sent by Richardson to Ortega before leaving to work on June 16, 2023. In the letter, I asked Ortega if he had any metamvitamine.
Ortega replied, “O comrades, you see the bars in the kitchen?”
Richardson replied, “Omg, where did Derek sleep all the time that he was supposed to watch (winter) while you were at work. Are they still there?”
Oretga replied, “They were there.”
Rayo called the number 911 on August 12, 2023. DA office wrote, “Winter parents waited more than 12 hours before calling the number 911 to report the death of their daughter.”
Rayo told the investigators that it might have rolled at the top of the winter while they slept together in a bedroom.
Court documents, “Winter DOE was located on the bed of the main bedroom with a folded rug on its dead body. In a table next to Winter DOE, SJPD officers are located in the Biotan flame, white pills, powder remains, and scraping tools.”
The anatomy of the medical examiner concluded that the child died from a poisonous group of metamphine and fentianil.
A second child died in San Jose, Phoenix Castro, who is 3 months old, due to the poisoning of fentanel a few months before the winter. Her father, David Castro, and Ortega of murder, were accused of the death of the child Phoenix.
“Evidence indicates that Castro sought and that Ortega provided drugs to Castro on the night before his daughter was dead at home. Ortega also provided deadly drugs that led to the death of the child’s winter after just 91 days.”
“The fact that the same man presented the deadly drugs that took the life of the child Phoenix and the winter of the child within months of each other is uncomfortable.”
A Castro and Ortega preliminary hearing will start on August 25.
